BACKCOUNTRY BROADBAND PRIVACY POLICY

Backcountry Broadband LLC ("Backcountry Broadband," "we," "us") provides this Privacy Policy to describe the information we collect from subscribers and users of our Internet and VoIP telephone services and our website and Customer Portal (collectively, the "Services"), how we use and share it, and the choices you have. This Policy is available at backcountrybroadband.com/privacy.html and is incorporated by reference into our Terms of Service and Residential Service Agreement.

The short version: we collect what we need to deliver, bill, support, and protect your service. We do not sell your personal information. We do not monitor the content of your communications. We share your information only with the service providers we partner with to deliver services.

1. Information We Collect

1.1 Account and Contact Information. Name, service address, mailing address, email address, phone number, account credentials, and communication preferences, provided when you order Service or manage your account.

1.2 Billing and Payment Information. Billing history, invoices, and payment status. Card and bank details are collected and processed by our payment processor and are protected in PCI compliant environments; Backcountry Broadband does not store full card numbers or bank account numbers on its systems.

1.3 Service and Network Data. Data generated by providing your Service: equipment identifiers, provisioning and configuration data, and equipment health telemetry (e.g., ONT status and light levels); network addressing assignments (IP and prefix delegations); and traffic flow metadata — records such as source/destination addresses, ports, protocols, timestamps, and byte counts (e.g., IPFIX/NetFlow) used for engineering, capacity planning, and security. Flow metadata describes traffic characteristics; we do not collect or inspect the content of your communications, and we do not maintain a record of the websites you visit for any purpose other than the operational and security purposes described in this Policy.

1.4 VoIP Records (CPNI). If you subscribe to VoIP telephone service, we generate call detail records (numbers called, time, duration, and related billing data) and your registered E911 address. These records are Customer Proprietary Network Information ("CPNI") protected by federal law (see Section 4).

1.5 Support Interactions. When you contact support, we collect the communications themselves: call recordings, voicemail, text/SMS threads, chat and email correspondence, and transcriptions. Calls may be recorded for quality and training; Colorado is a one-party-consent state, and our systems provide notice of recording.

1.6 Website and Portal Data. Standard technical data when you use our website or Customer Portal: log data, device/browser type, and session information. We use primarily use essential cookies required for login sessions but may also use third-party advertising or analytics trackers.

2. How We Use Information

We use the information above to: provision, deliver, maintain, and repair the Services; bill and collect for the Services; authenticate you and secure your account; provide customer support; engineer, plan, and protect our network (including detecting outages, congestion, abuse, and security threats); comply with law; and communicate with you about your account, service notices, and — with your consent where required — offers.

Automated and AI-Assisted Processing. Backcountry Broadband may use automated systems, including artificial intelligence, to process customer interactions and account information — including transcribing and analyzing support calls and text messages, routing inquiries, and improving service quality. When you interact with an automated assistant, we will identify it as such. AI processing primarily occurs on Backcountry Broadband-operated systems; where we use third-party AI services, they act as our service providers and are directed not to use data for their own purposes, including training their models. We do not sell customer communications. Decisions materially affecting your account or service are subject to human review upon request.

3. How We Share Information

We do not sell personal information, and we do not share it with third parties for their own marketing.

We share information only with:

  • Service providers (processors) acting on our instructions under contract — currently including Stripe (payment processing) and Twilio (telephony and messaging transport) — limited to what each needs to perform its function.
  • Legal process and protection of rights. We disclose subscriber information only as permitted or required by law. Consistent with the Stored Communications Act (18 U.S.C. §§ 2702–2703): we disclose the content of communications to government entities only pursuant to a warrant or an applicable statutory exception; we disclose non-content subscriber records pursuant to valid legal process; and we may disclose information without process where necessary to protect our rights, property, and subscribers, or in emergencies involving danger of death or serious physical injury. Where permitted by law, we will notify you of legal demands for your information.
  • Business transfers. If Backcountry Broadband or its assets are acquired or reorganized, subscriber information may transfer to the successor, which remains bound by this Policy until it is amended per Section 9.

4. CPNI (VoIP Subscribers)

Federal law (47 U.S.C. § 222 and FCC rules) protects CPNI. We use CPNI to provide and bill your VoIP service, for support, and to protect against fraud and unlawful use. We do not use your CPNI for marketing without your approval, and you have the right to withdraw any approval at any time; refusing approval will not affect your service. We authenticate subscribers before disclosing call detail information in customer service interactions, and we will notify you of certain account changes (such as password or address-of-record changes) as required by FCC rules.

5. Data Retention

We retain personal information only as long as reasonably necessary for the purposes described in this Policy — including providing, supporting, and billing the Services; network engineering and security; resolving disputes; and meeting legal, tax, and audit obligations — and then delete or de-identify it. Retention periods vary by category of information and are determined by these operational and legal needs; operational network telemetry is generally retained for shorter periods than account and billing records. Information subject to a legal hold, billing dispute, or lawful preservation request is retained at least until the matter concludes.

6. Security

We maintain an information security program aligned to the NIST Cybersecurity Framework, including access controls, encryption in transit, network segmentation, logging and monitoring, and vendor management. No system is perfectly secure; if a security breach affects your personal information, we will notify you in accordance with the Colorado Security Breach Notification Act (C.R.S. § 6-1-716) and other applicable law.

7. Your Choices and Rights

  • Access and correction: view and update your account information in the Customer Portal, or contact us.
  • Requests: you may request a copy, correction, or deletion of your personal information by emailing support @ backcountrybroadband.com. We honor such requests except where retention is required for billing, legal, security, or operational purposes, and we will explain any refusal.
  • Marketing: you may opt out of marketing communications at any time; service and account notices will still be sent.
  • CPNI approval: see Section 4.

8. Children

Our Services are sold to adults (18+). We do not knowingly collect personal information from children. Account holders are responsible for household use of the Services.

9. Changes to this Policy

We may update this Policy as our practices or the law change. The current version always available at the URL above and version history by request. We will notify subscribers of material changes as described in the Terms of Service, and material changes will not be applied retroactively to previously collected information without notice and, where required, consent.
